In accordance with the Ley Federal de Protección de Datos Personales en Posesión de Particulares (otherwise known as, the Law) its regulations and other applicable standards, this Privacy Notice will explain the existence and main characteristics of the processing and tratment to which your personal data will be subjected, to allow the exercise of your rights to information, self-determination, privacy and protection of personal data.

Our database is concentrated in Calzada Cuauhtémoc 1328 sur. Colonia Centro. C.P. 27000, Torreón, Coahuila, which is duly protected in accordance with applicable law.

 

  1. Personal data that will be collected by “SAPSA”

 

To fulfill the purposes set forth in this Privacy Notice, "SAPSA" will collect personal data (Name; Address; Date and place of birth; Gender; Nationality; Age; Particulars; Marital status); personal identification data (Civil society activities or volunteering; Credential issued by the Instituto Nacional Electoral; CURP; Driving license; IMSS membership number; Passport; Federal Taxpayer ID; Family identification data - ascendants and descendants -), personal authentication data (Military chart; Signature; Photograph; Blood type; Legal representative power of attorney; Fingerprints); personal contact data (E-mail; Address; phone number); personal academic data (School certificates and diplomas; Language accreditation; Educational level; Professional certification number; Educational background); and personal work data (e-mail address; business address and telephone; Personnel development; Job title; Company) .

 

To comply with the purposes set forth in this Privacy Notice, "SAPSA" will process sensitive personal data (Medical condition; Medical history; Baptismal certificate; Union membership; Laboratory examinations; Medical data of the spouse and children; psychometric tests; Administrative, administrative who has occupied operational positions and operative personnel medical file; Employment references; Number of IMSS clinic; Date of discharge to IMSS; Skin type) and financial data (Beneficiaries of the Savings Fund; Testamentary Letter; Interbank CLABE; Afore Record; Fonacot Credit; INFONAVIT Credit; Profuturo-GNP Credit; Bank and Branch Account; Tax information; Income; Salary; Socioeconomic studies)

 

Use of Cookies, SDK's, Tracking Technologies and Similar

 

We inform you that through our portal we may make use of Cookies, SDK ("Software Development Kit" or "Software Development Kit") and other technologies, however, "SAPSA" cannot read data from your hard drive, nor read the "cookie" files created by other suppliers. The use of these technologies allows “SAPSA” to recognize previously registered users to be able to access the areas and services exclusively reserved for them, without the need to register each time. III. Purposes for the processing of your personal data

 

Primary Purposes: "SAPSA" will process your personal data for the following primary purposes:

  2. To contact you through the data you provided;
  • To manage your curriculum information and offer you employment opportunities;
  1. To offer you the commercialization of the services that we make available to you;
  2. To answer the questions of those users who may have doubts regarding our services through our web, and
  3. To follow up on requests for services made by users through our website.

 

The personal data collected by SAPSA, will never be used for Secondary Purposes.

 

  1. Basis for the legitimacy of the processing of your personal data

 

In those cases in which the processing of your personal data could not be covered by any legal relationship sustained with "SAPSA", your consent will be needed; except in cases where our user has entered our website, since to do so it is necessary to provide consent to process your information.

 

  1. Portability of your personal data

 

"SAPSA" may transfer, without requiring your consent, the necessary personal data to competent authorities in the cases legally provided by the first paragraph of article 16 of the Constitución Política de los Estados Unidos Mexicanos, as well as to subsidiaries and affiliates of " SAPSA ”, which operate under privacy policies that comply with the corresponding applicable provisions to comply with the purposes indicated in this Privacy Notice, the foregoing based on section III of article 37 of the Law.

 

  1. Means and procedures to Exercise Data Protection Rights ("ARCO"), exclusion for the treatment and for the revocation of consent for the treatment of personal data

 

You have the right to know what personal data we have, how we use it and the conditions of use that we give [access]. Likewise, it is your right to request the correction of your information if it is outdated, inaccurate or incomplete [rectification]; that we delete it from our databases when you consider that it is not used in accordance with the principles and duties provided for in the Law [erasure]; likewise, you may object to the use of your data for specific purposes [object to processing].

 

The rights indicated in the previous paragraph are called “ARCO” rights; for their fulfillment, you must submit a written request to the following email:  [email protected]

 

The written request must contain:

 

  1. Full name and address.
  2. Document with which you prove your identity (copy of a valid official identification with photograph and signature).
  • Clear description of the right you wish to exercise / what you request.
  1. Clear and precise description of the personal data with respect to which you seek to exercise any of the aforementioned rights.
  2. Any element or document that facilitates the location of personal data.
  3. In the event of any rectification or modification of personal data, you must indicate the change that must be made and provide the documentation on which your request is based on.
  • Optionally: send an email to which the response to your request will be sent.
  • In case of presenting the document through your legal representative, you must also attach a simple copy or digitization of the power of attorney by which the representative is designated, with sufficient powers to exercise ARCO rights; as well as some official identification with photograph and signature of the representative (INE, Passport or Migratory Document that confirms the legal stay of the foreigner in the country).

 

In the event that the information provided in your writing is erroneous or insufficient, or the corresponding accreditation documents are not attached, the of "SAPSA’s” Administrator, within five (5) business days following receipt of the request, may require you to provide the elements or documents necessary to process it. You will have ten (10) business days to meet the request, counted from the day after you have received it. If no response is provided within said period, the corresponding request will be deemed not submitted.

 

The “SAPSA”’s Administrator will notify you of the agreed decision, within a maximum period of twenty (20) business days from the date the request was received, so that, if appropriate, it can make it effective within fifteen (15) business days after the response is communicated. The answer will be delivered electronically to the email address specified in your letter.

 

VII. Means to Limit the Use or Disclosure of Your Data

 

You may limit the use or disclosure of your personal data by sending your request in a writing document and delivering it to the Administrator following the terms specified in the previous point.

 

In case your request is appropriate, you will be registered in the “SAPSA” exclusion list. For more information, please contact the “SAPSA’s” Administrator.

 

Likewise, we inform you that there are other mechanisms to limit the use and disclosure of your data such as the Registro Público para Evitar Publicidad (REPEP) of the PROFECO, or the Registro Público de Usuarios (REUS) of the CONDUSEF, which you can access through the websites of the aforementioned institutions.

 

VIII. Personal Data Protection Authority

 

Should you wish to report a complaint or if you feel our Administrator has not addressed your concern in a satisfactory manner, you may contact the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI).
